(x) Community Basketball Waiver

 

1. Express Assumption of Risk

I hereby acknowledge that participating in basketball games, tournaments, practices, training sessions, and related activities involves inherent risks. Pursuant to Georgia law regarding recreational activities, these risks include, but are not limited to:

• Minor injuries such as scrapes, bruises, sprains, and muscle tears.

• Major injuries such as broken bones, joint dislocations, concussions, and cardiac events.

• Catastrophic injuries, including permanent paralysis, severe brain damage, or death.

I voluntarily choose to participate in these activities and expressly assume all risks associated with my participation, whether known or unknown, visible or hidden. I acknowledge that this is a "Play at Your Own Risk" activity.

2. Release, Waiver, and Indemnification (Hold Harmless)

In consideration for being permitted to use the facilities, participate in the games, or receive training, I hereby release, waive, acquit, and forever discharge the following entities and individuals (collectively referred to as the "Released Parties"):

• The Court Locations, Parks, and Schools hosting or providing the facilities (including public, private, and municipal entities).

• The Trainers, Coaches, and Referees organizing, instructing, or officiating the activities.

• The Businesses, Sponsors, and Vendors supporting or operating at the events.

• The Other Players and participants in the program.

I agree to hold harmless and indemnify the Released Parties from any and all claims, demands, causes of action, lawsuits, damages, or liabilities (including attorney's fees) arising out of or related to:

• Any bodily injury, personal injury, illness, or death suffered by me.

• Any loss, theft, or damage to my personal property while on the premises.

• Any claims made by my health insurance provider, auto insurance provider, heirs, or legal representatives.

This release applies specifically to any claims based on ordinary negligence by the Released Parties, breach of contract, or any other legal theory, to the fullest extent permitted by the laws of the State of Georgia. (Note: Under Georgia law, this does not release liability for gross negligence, willful or wanton misconduct, or intentional torts).

3. Insurance and Medical Acknowledgment

• I confirm that I have adequate health and/or accident insurance to cover any medical expenses resulting from an injury sustained while playing.

• I understand and agree that the Released Parties do not provide medical or accident insurance for participants.

• In the event of a medical emergency, I authorize event staff or participants to secure first aid or emergency medical treatment on my behalf. I accept full financial responsibility for any such treatment.

4. Severability and Governing Law

This agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Georgia. I agree that if any portion of this agreement is found to be void, invalid, or unenforceable by a Georgia court of law, that portion shall be severed, and the remaining portions of the agreement shall continue in full force and effect.

5. Terms Check Box Acknowledgment

By checking, I certify that I am at least 18 years of age, that I have read and completely understand this waiver, and that I freely and voluntarily agree to all of its terms.
